During the sale of Gwen’s home in Saratoga, the buyers bank required a certificate of occupancy for the finished basement. We did not have that and found we had to hire an architect to draw up plans and tell us what is required to get the certificate of occupancy. The architect indicated as one room could be used as a bedroom additional egress, ventilation, and light had to be provided which would involve 10’s of thousands of dollars and not be possible considering the exterior of the building. Upon consulting Bob Kocis, he reviewed his code books and asked when the basement was finished. We replied around 2003. Bob indicted then that it would fall under the old code per R310.6” Alterations or repairs of existing basements. a. An emergency escape and rescue opening is not required where existing basements undergo alterations or repairs.” What the Architect would have to do is remove the door and part of the wall of the room that could be used as a bedroom and indicate on the plans “Basement finished storage / recreation-non habitable No sleeping No cooking.
The architect was not aware of this and without Bob’s help and knowledge the sale would not have gone through.
